The Art of Skip Tracing

In its simplest terms, skip tracing is a procedure, or set of procedures, utilized to locate an individual. That individual is usually referred as the “skip.” The fundamental objective of a skip trace is to locate the skip.

There are a multitude of reasons as to why a person might be sought out. It could be:

  • To serve legal documents on the person if you are a process server.
  • To arrest the person if you are a bounty hunter.
  • To interview him or her as a witness if you are a private investigator.
  • To collect money from someone if you are a collection agent.
  • To get a story from someone if you are a journalist.

The person doing the skip tracing is known as a skip tracer. A professional skip tracer understands not only how to locate various types of information about a person (the skip) but also how to merge and analyze that information. A professional knows how to leverage information in a manner which leads to additional information and, eventually, to the skip.

There are many sources of information about people. They range from the mundane (such as a neighbor) to the sophisticated (such as data brokers). Here is a short list, most of which will be discussed later in this course.

  • Phone number databases
  • Credit header reports
  • Credit card applications
  • Job applications
  • Criminal background checks
  • Loan applications
  • Public records databases
  • Courthouse records
  • Driver’s license records
  • Vehicle registration departments

Skip tracing is a branch of work usually associated with private investigators. In Washington, skip tracers are required to be licensed as a private investigator or in some other professional capacity which is exempted from the PI licensing laws.

Basic Knowledge

“Basic” knowledge is defined as something which is necessary to know or learn. For instance, in arithmetic it is vital know how to add and subtract. Such knowledge is needed before you can successfully conduct business or advance into the higher levels of mathematics, such as algebra or calculus. 

For skip tracers, basic knowledge consists of knowing about the resources available and how to access them. Most anyone can do this but most people don’t progress beyond this level. 

Applied Knowledge

Applied knowledge is learning that is used in various situations and contexts. Various procedures and analytical tools are used to formulate and generalize concepts to solve diverse problems and situations. This is the art aspect of skip tracing. It is the ability to draw on various pieces of basic knowledge in order to utilize them in different ways in order to locate the skip.

For instance, if you are tasked with locating John Smith it is immediately obvious this is nearly impossible. Why? Because you do not have enough information about the skip, there are simply too many John Smiths in the world. You don’t have enough information to sort through all the John Smiths in order to identify the particular one your client is seeking. A professional skip tracer knows how to elicit more information from the client. Information such as the skip’s:

  • Date of birth
  • Social Security Number
  • Old address
  • Relative’s names
  • Associate’s names
  • Approximate age
  • etc

If such information is not available, a professional is also secure enough in him or her self to decline the assignment when it is obviously impossible to achieve.

Conclusion

As with any other profession or trade, learning the art of skip tracing takes time and experience. Sources of information are constantly changing and the way in which they fit together is evolving. What worked yesterday will not necessarily work tomorrow. Things which were old are new again and the professional skip tracer knows how to adapt and work around obstacles.

For example, during 2017 and 2018, the State of Washington’s court system completely revamped its computer system which is known as JISLink.. In doing so they discovered errors in the old system which related to the way in which address information was displayed. They couldn’t create a work around in the programming so they decided to not display any address information at all. This was a serious inconvenience to skip tracers.  But the professionals in the industry took it in stride and found new ways to get the same information via alternative resources.

Professionals perform their work in a manner which is consistent with the law and there are numerous laws which regulate access to information and the purposes for which it can be used. This course will only describe methods and resources which are legal and ethical. 

One last thing before we move on. As mentioned above, skip tracing is a form of investigations. With certain exceptions, skip tracers are private investigators and must be licensed as such. There is one provision in the law which applies specifically to skip tracing, it is RCW 18.165.160(11). It defines the following as unprofessional conduct and subjects the investigator (aka skip tracer)  to disciplinary action by the Department of Licensing. It is also possible criminal and 

(11) Assisting a client to locate, trace, or contact a person when the investigator knows that the client is prohibited by any court order from harassing or contacting the person whom the investigator is being asked to locate, trace, or contact, as it pertains to domestic violence, stalking, or minor children;

We will discuss this statute later in greater detail.
