PS 102 – Chapter 3 – An Introduction to Immunity from Service Case Law

Under certain circumstances a person is immune from service of legal process. Thankfully, such immunity requires that for a person to be immune then a very specific set of circumstances must exist and it is only while they exist that the person is immune.

Immunity from service of process is not based in statutory law but in case law. It is sometimes provided to nonresidents who are in the state for the sole purpose of attending a local judicial proceeding. But even then the immunity is not an impervious shield protecting the person from service.

As you will see, the higher courts have ruled in various ways depending upon the circumstances of the documents and upon the nature of the underlying action.

The courts see immunity as a privilege extended by the courts to certain individuals under certain circumstances. It is a privilege which can be withdrawn, seemingly, at the whim of the court.
