PS 101 – Chapter 5 – Chapter Outline – Service of the Summons

Chapter 5 brings you to the summons, the single most served legal document you will handle.

The summons is the initiating document in the vast majority of civil cases brought every year.  Without it a case never gets started.

The summons informs the defendant the power of the state is being brought to bear against him or her.  It informs the defendant of some of their rights and tells them how to go about responding to the suit which is being brought.

The summons itself rarely changes in its fundamental form or function.  Instead, it is the nature of the defendant which determines what manner of service must be used in order to give proper notice.  This chapter concentrates on RCW 4.28.080 and its 16 paragraphs.

Entities of many different types are subject to the power of the court system. Each must be served in a manner defined in the law. A professional process server must know how to achieve service on each of them.

In this chapter you will learn about service on:

  • A city
  • A county
  • The state
  • Railroads
  • Corporations
  • Persons with a guardian
  • Minors
  • Persons
