Pleading

A pleading is a formal written statement filed with the court in which a party sets out its claims or defenses in a lawsuit. Common pleadings include the complaint, answer, counterclaim, cross-claim, and reply.

For process servers, pleadings matter because they define what is being served and why service is required. The initial pleading, usually the complaint, triggers the need for service of process and establishes the legal basis for the action. Subsequent pleadings may also require service, depending on court rules and the posture of the case.
