PS 101 – Chapter 4 – Article 1 – Process Server Registration

18.180 RCW governs the registration of process servers.

With certain exceptions, any person who serves legal process for a fee must register with the county auditor of the county in which he or she lives or in which he or she has a principal place of business. Registration only needs to be done once and not in each county in which process is served.

The following are exempted from this requirement:

  • A sheriff, deputy sheriff, marshal, constable, or government employee who is acting in the course of employment;
  • An attorney or the attorney’s employees, who are not serving process on a fee basis;
  • A person who is court appointed to serve the court’s process
  • A person who does not receive a fee or wage for serving process.
  • A licensed private investigator.

The registration is valid for one year and must be renewed on an annual basis. Renewal is also required when the server’s information (such as address, telephone number, etc) changes.

Registration is required of anyone serving process for a fee. This includes employees of a registered process server. Since in many companies any employee might need to perform a service, even if only rarely, it makes sense to register all employees.

The registration number assigned by the auditor must be shown on each Proof of Service signed by the server.

A party in a case can only collect as costs the fee they paid for service if they use a registered process server or a server who is exempt from the registration requirements (see above). If a party uses a server who is not registered, but under 18.180 should be so registered, the party may still collect the service fee as costs if the process server registers within 45 days after serving the documents.

The registration fee should be $10 and no more. Some county auditors incorrectly add other fees to the registration fee. Any fee above $10 should be protested.

Finally, in order to register as a process server, you must be a resident of Washington.
