PS 102 – Chapter 10 – An Introduction to Who May Serve Case Law

The basic requirements for who may serve legal process in Washington create a very short list. You must be:

  • Age 18 or above
  • Not a party to the action
  • Competent to be a witness at the time of service and at the time of testimony

If you are going to serve for a fee there are a couple of extra items to add:

  • Registered with your county Audior (unless you qualify under one of the exemptions)
  • A citizen of the state

As you will see, the list of appellate cases involving this topic is also rather short. That said, the cases which do come up are almost always of an interesting nature.
